Marina concession promoted at the Port of Ensenada

The National Port System Administration of Ensenada, S.A. de C.V. published a public call on May 28 for the development, construction, equipment, and operation of a public marina to provide specialized port and tourist services, including a commercial area. The call, named ASIPONA/ENSENADA/01/24, was published on May 28 in the Official Gazette of the Federation, but only shared on ASIPONA’s social networks (formerly API) on June 6.

The invitation indicates that ASIPONA, based on the Master Plan for Port Development of the ports of Ensenada, El Sauzal, and Costa Azul 2023-2028, invites all Mexican or foreign individuals and legal entities interested in participating in the Public Contest ASIPONA/ENSENADA/MARINA/01/24.

The requirement is to have a minimum equity capital of $25,000,000.00 (Twenty-five million pesos 00/100 M.N.), which corresponds to the awarding of a contract for the partial transfer of rights derived from the Concession Title, with a term of 19 (nineteen) years and the possibility of extension for up to 19 (nineteen) years.

This would be for the use, enjoyment, and exploitation of a maritime area of 12,000 m2, for the construction, equipment, and operation of a public marina for the provision of specialized port and tourist services, including a commercial area.

Additionally, the construction and operation of a commercial area with a restaurant, bathrooms, convenience store, and sale of nautical items, fuel station, among others, for the provision of port and tourist services, will be developed under the terms established in the bases.

The provision of port and tourist services for the attention of recreational, tourist, and sports vessels, such as boarding and disembarking, mooring, in-water repair, provisioning, supply of drinking water, fuel, communication (internet, telephony, voice, and data), garbage collection, diving, maritime inspection, the services and facilities described in article 52 of the Ports Law Regulation, as well as other tourist services and further activities typical of the marina and its commercial area that the assignee will provide to users, under the terms established in the bases.

Among the obligations acquired by the winner of the tender is to demolish the facilities currently within the area to be ceded, to allocate it to the construction and operation of the marina and its commercial area, in accordance with the terms and conditions indicated in the bases.

To carry out in the area to be ceded the minimum committed investments in works and facilities for the development of the marina, by the winner and awardee of the contest, as well as to equip and operate it.

To guarantee the fulfillment of the contract and the minimum committed investments in works and facilities.

To recognize the vessels located at the dock named “Inmobiliaria Plaza Villa del Río” located in the area to be ceded and that, being up to date in the fulfillment of their obligations, have obtained the compliance certificate from ASIPONA, in accordance with what is established in the bases and the descriptive prospectus.

The area in question is located in the Ventana al Mar zone, one of the most visited by local tourism within the port harbor.
